Terms of sale

These terms apply to every purchase from botanicaessentia.com. By placing an order you agree to them. Please also read our Shipping and Returns and Privacy Policy, which form part of these terms.

1. Who you are buying from

Botanica Essentia, LLC, a Missouri limited liability company, Columbia, Missouri. Botanica Essentia is a brand of Wise Women Botanicals. Contact: hello@botanicaessentia.com.

2. Our products

Botanica Essentia products are cosmetics for external use. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or condition. Nothing on this site is medical advice. If you have a skin condition, are pregnant or nursing, or have a known sensitivity to any listed ingredient, consult your healthcare practitioner before use.

Patch test every product before first use and discontinue if irritation occurs. Keep products away from eyes and out of reach of children. Products are supplied in glass; handle with care.

Ingredient lists are printed on each product and shown on its page. Natural ingredients vary in color and scent from batch to batch; this is not a defect.

3. Placing an order

An order is an offer to buy. We accept it when we send you a shipping confirmation. We may decline or cancel an order before shipment, for example if a product is out of stock, a price was shown in error, or we suspect fraud, and we will refund any payment taken.

You must be 18 or over to order.

4. Prices and payment

Prices are in US dollars and exclude shipping and any sales tax, which are shown before you confirm the order. Payment is taken in full at checkout through Square. We may change prices at any time; the price shown when you order is the price you pay.

Sales tax is charged where the law requires it, currently on orders shipped within Missouri.

5. Shipping and risk

Shipping options, costs, and timelines are set out in Shipping and Returns. We ship to addresses in the United States only. Risk of loss passes to you when the carrier delivers to the address you gave us. Please give us a secure delivery address.

6. Returns and refunds

Our return rules are in Shipping and Returns. In short: unopened products may be returned within 30 days of delivery; opened products only if they arrived damaged or are defective. Refunds go to the original payment method.

7. Wholesale and professional orders

Wholesale, spa and professional purchases are made under a separate agreement. Write to hello@botanicaessentia.com. These terms do not grant any right to resell.

8. Intellectual property

The Botanica Essentia name, crest, product names, photographs and text on this site belong to Botanica Essentia, LLC or its licensors. You may not reproduce them without written permission.

9. Liability

To the fullest extent the law allows, our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for personal injury caused by our negligence, or affects any consumer rights you have under the law of your state.

10. Governing law and disputes

These terms are governed by the laws of the State of Missouri. Before any formal dispute, please contact us; most problems can be sorted out by email. Any dispute that cannot be resolved will be brought in the state or federal courts located in Boone County, Missouri, unless the law of your state gives you the right to bring it elsewhere, including in a small-claims court where you live.

11. Changes

We may update these terms. The version in force when you order applies to that order.
